How UAE End-of-Service Gratuity is calculated (Article 51)

Under UAE Federal Decree-Law No. 33 of 2021, full-time foreign workers in the UAE private sector who complete at least one continuous year of service are entitled to end-of-service gratuity calculated on their last basic wage (excluding housing, transport, utilities and other allowances):

  • First 5 years of service: 21 working days' basic wage for each year of service (21 × (Basic Monthly Salary ÷ 30) per year).
  • Each year beyond 5 years: 30 working days' basic wage for each subsequent year of service (30 × (Basic Monthly Salary ÷ 30) per year).
  • Fractions of a year: Once you have completed 1 full year, any additional months and days are paid proportionally.
  • Unpaid leave exclusion: Days of absence without pay are deducted from the total service duration (Article 51(4)).
  • Statutory cap: Total end-of-service gratuity cannot exceed two years' total wage (Article 51(7)).
